Scott Newman is a full-service Criminal Defence lawyer based out of Winnipeg, MB. He graduated as class valedectorian at Robson Hall Law School at the University of Manitoba. Throughout law school Scott worked and articled for Greg Brodsky, Q.C., learning directly from the legendary lawyer for three years.Scott has successfully defended charges throughout the Highway Traffic Act, Criminal Code and the Controlled Drugs and Substances Act (CDSA).
In 2016, Scott successfully convinced the Manitoba Court of Appeal to strike down a law limiting pre-sentence custody on offenders denied bail in R. v. Bittern, 2016 MBCA 19. The Supreme Court later agreed with Scott's argument regarding the unconstitutionality of the law in R. v. Safarzadeh-Markhali, [2016] 1 S.C.R. 180.
Scott has also successfully struck down, and upheld, Protection Orders under the Domestic Violence and Stalking Act, and has also successfully struck down, and upheld, Peace Bond applications under Section 810 of the Criminal Code.
Scott has also defended regulatory charges, such as hunting charges under the Wildlife Act, illegal tobacco violations under the Tobacco Tax Act, and interference with aircraft under the Aeronautics Act.
Scott has appeared at numerous quasi-judicial Provincial Boards and Tribunals, including the License Suspension Appeal Board, and the Manitoba Criminal Code Review Board.
Scott frequently volunteers in the community. You might see him lecturing to high-school students about the legal profession, mentoring law students, coaching moot trial teams, or conducting educational seminars for other lawyers.
Scott has been the spokesperson for the Criminal Defence Lawyers Association of Manitoba (CDLAM), since 2010.
